Public Education: Administration and Governance
We provide advice on all aspects of administration and governance. We assist in questions related to budget, finance, audits and audit responses. We are experts in the areas of conflicts of interest including Government Code section 1090 conflicts, Political Reform Act conflicts, and common law conflicts of interest. Clients regularly call on us to offer advice and counsel about whether a conflict exists, and what the effect the conflict has. We routinely train on all types of conflict of interest topics. We have advised many clients as they move from at-large to district elections and from odd-year to even-year elections. We are expert on the issues that arise with a change in election practices. Finally, we are passionate about the Brown Act and all the many issue that come up regarding agendas, proper reporting out, and what information is proper in closed session.
Expertise
We provide virtually daily advice to our clients on the full gamut of Brown Act issues – including agenda preparation, postings, meeting locations, permissible closed session matters and compliance with the 24-hour notice rights of employees.
We regularly provide written opinions and advice to our clients on the Public Records Act (PRA). We regularly provide advice as to documents subject to disclosure versus those that fit within an applicable exception. We handle PRA challenges in court and regularly assist clients with document productions under the PRA. We also handle PRA requests from various different contexts, including employment, construction and bidding.
We advise on statutory interpretation of various California Codes, including the Education, Government and Elections Codes. Our related experience includes interpretation and implementation of the California Voting Rights Act, Federal Voting Rights Act, redistricting, election procedures and related policies and procedures.
We regularly work with Boards in everything regarding board efficiencies and the role of the Board.
A core part of our governance work involves assisting boards with their governing documents. LCW attorneys routinely work with Boards to prepare or update their governing documents, including articles of incorporation, bylaws and Board member handbooks, as well as various Board policies, to ensure compliance with laws and best practices.
